Building codes for an outdoor toilet window?

The window for my original outdoor toilet (1960) is fixed pane louvre. The toilet opens to the outside.

From what I understand, to meet ventilation requirements windows should be

1. openable

2. a certain size (no less than 5% of the floor area)

if that's right, does that mean a fixed pane louvre window doesn't meet requirements, even if a window is the right size?

The ventilation requirements you’re referring to come from the NCC / BCA, which apply to new work or when you’re doing alterations that trigger compliance. For sanitary compartments, the code generally requires either natural ventilation via an openable window of at least 5% of the floor area, or mechanical ventilation that meets the required airflow rates.

In your case, a fixed louvre window that is permanently open effectively provides constant natural ventilation. Because it can’t be closed, it’s arguably better ventilated than an “openable” window that might be shut. From a practical ventilation point of view, there’s no real issue there.

The other important point is that this is an existing structure. Building codes are generally not applied retrospectively. As long as you’re not doing building work that requires approval (for example, enclosing the toilet, changing its use, or replacing the window as part of regulated work), the existing condition is usually considered acceptable under the rules that applied at the time it was built. This is often referred to as being “grandfathered”.

If there’s any concern or uncertainty, especially if you’re planning future works, it would be worth having a brief discussion with a builder or building surveyor. They can confirm how the NCC is being interpreted locally and whether the existing window arrangement is acceptable, which can save you from making unnecessary changes.
